Over the years of representing clients who have been charged with having child pornography on one or more of their devices, a pattern of stories has come up. Before I get to that, I want to be clear how serious of an accusation this is. In Arizona, child pornography is referred to as ‘sexual exploitation of a minor’. Sexual exploitation of a minor is not a crime that the state of Arizona takes lightly. It carries a presumptive punishment of 17 years in prison, per picture. If you have more than one picture, the 17-year punishments are stacked on top of one another, for 17 years of prison time, separately, for each individual picture. So at the presumptive sentencing level, 5 pictures depicting sexual exploitation of a minor would carry a presumptive 85-year prison sentence—Josephine Pesaresi Hallam.

Often, new clients give some version of one of five basic storylines to explain the presence of child sexual exploitative material on their devices:

  1.    1.     I have open Wi-Fi accessibility in my house, so someone else must have gotten on my Wi-Fi and downloaded it. It wasn’t me, but it’s showing that it came from my IP address because they got on my Wi-Fi.
  2.     2.     Other people have access to my devices, and my access code is readily known.
  3.     3.     I am a vigilante, either trying to find child pornography to report it to the authorities, or to single-handedly catch and trap people distributing child pornography, and then report them to the authorities.
  4.     4.     I was looking at regular pornography, and one picture of child pornography popped up that must have been mixed up in the large photo dump I downloaded onto my computer.
  5.     5.     I admit, I have child pornography on my phone. It started as an addiction to regular pornography, and I fell down some sort of dark rabbit hole. I’ve wanted to stop every day since I started looking at it and I don’t know where to go for help.
